The website www.autoricambimoncalieri.com, and other internet domains registered in the name of O.T.M. s.r.l., is dedicated exclusively to wholesale and retail sales. The general conditions of sale are governed by Italian law and in particular by Legislative Decree 70/2003 relating to electronic commerce and by Legislative Decree 206/2005 with specific reference to the legislation on distance contracts.

1. Definitions

For the purposes of these general conditions of sale, and in addition to the other definitions contemplated therein, the following terms will have the meaning set out below:


   General conditions: these are all the conditions of sale applicable to the contractual relationship between O.T.M. s.r.l. and the Customer.


   O.T.M. s.r.l. is the company that intends to carry out the sale through the Website at the address www.autoricambimoncalieri.com (O.T.M. s.r.l.) and other internet addresses registered by O.T.M. s.r.l.


   Products: are all the products and/or goods marketed by O.T.M. s.r.l. and part of its assortment.


   Website: is the set of web pages relating to www.autoricambimoncalieri.com and other internet domains registered by O.T.M. s.r.l.


   Promotions: these are the sales made by O.T.M. s.r.l. for all or part of the products and for limited periods of time with a discount on the normal selling price.


   Orders: is the purchase order with delivery of the Products to the Customer's home or through the option of collection in the Store.



2. Scope of Application - Effects

The General Conditions apply to any sale concluded between the Customer and O.T.M. s.r.l. and carried out through the Site or by telephone communication. Sending an order implies acceptance by the Customer of these General Conditions; the General Conditions exclusively concern the sale to a consumer Customer;

Any changes or new conditions of sale will be effective from the moment of publication on the Site and will be applied only to sales concluded after publication.


3. Contract formalisation

All contracts are concluded with access by the Customer to the Site, using remote communication technology via the Internet, or by telephone communication by contacting the O.T.M. Customer Service in this case. s.r.l.

All purchase orders sent to O.T.M. s.r.l. must be completed exactly in all their parts and must contain the elements necessary for the exact identification of the Products ordered, of the Customer and of the place of delivery of the Products;

The contract is considered concluded, and is binding for both parties, when the purchase order confirmation is sent to the Customer. This order confirmation will be sent by e-mail and will contain the wording "Summary" in the "Subject" field. O.T.M. s.r.l. will be able to automatically send a thank you email to the customer automatically generated upon receipt of the order. This thank you email should not be considered as order confirmation;

O.T.M. s.r.l. reserves the right not to accept incomplete or not duly completed orders.

The O.T.M. s.r.l. also reserves the right (at its full discretion) not to accept/fulfill orders due to PAST ABNORMAL BEHAVIOR / NON-PAYMENTS / CONTINUED PRODUCT RETURNS.

The customer has the right to cancel the order within a maximum of 12 hours from the forwarding of the same or from the balance of the same by bank transfer or postal order. After 12 hours from these events, all orders are considered definitively confirmed. Any exceptions to this point may from time to time be accepted by O.T.M. s.r.l.. Order cancellations can be made by telephone or email.

In any case, once the product has been delivered by O.T.M. s.r.l. s.r.l. to the carrier, no order can be canceled by the customer, who can still claim the right of withdrawal.


4. Delivery Times and Methods

O.T.M. s.r.l. shall deliver the Products to the Customer, selected and ordered in the manner referred to in the previous article, by trusted couriers and/or shippers, or personally with their representatives; the O.T.M. s.r.l. undertakes to send the materials in the times and in the manner indicated on the website. It is the customer's responsibility to verify the correctness of the data in the order confirmation sent via email. Any strikes, transport suspensions, etc. constitute force majeure and O.T.M. s.r.l. will carry out the deliveries in the shortest possible time.

Delivery times are indicated on the website and refer to goods ready in our warehouses and are to be understood as indicative in any case. Any delays cannot give rise to claims for compensation for any direct or indirect damages by the purchaser.

The delivery of the order generally takes place on the day indicated in the shipment tracking email, even if this date is not binding on O.T.M. s.r.l. mandatory delivery on the day indicated in the email;

The delivery costs of the Products are charged to the Customer. Free shipping costs and/or special services or different conditions in terms of shipping can be agreed individually between the customer and O.T.M. s.r.l. by telephone conversation. These agreements will be formalized through a specific communication in the order summary email; The collection of the order in the Store is always free, provided that the ordered product is present in our warehouse in Turin, otherwise 9 Euros will be charged even with the collection in the Store;

The delivery of the Products is subject to payment by the Customer of the relative price with the means chosen among those made available by O.T.M. srl; on the payment methods page there is further information on the matter;

The order will be delivered in sealed packages or envelopes; for organizational reasons, efficiency and economy of the service, the order cannot be opened, verified or controlled by the Customer before the payment of the same (unless different and specific agreements are made with O.T.M. s.r.l. and in any case not by means of cash on delivery);

Conditions and terms of delivery other than those provided for in the General Conditions of Sale must be agreed in advance between the Customer and O.T.M. s.r.l. and accepted by the latter through the order confirmation sent by email;

The tax documentation (invoice and/or tax receipt) is issued by O.T.M. s.r.l., by e-mail and/or by means of an accompanying invoice physically attached to the package or in any case it will be delivered later at the customer's request;

For the delivery of the Products, the presence of the Customer or his representative at the address and at the time indicated on the order is required. It is the Client's duty to collaborate in order to be available on the scheduled day of delivery of the order. The courier will make two further deliveries in the following days; at the third missed delivery, the courier will return to the sender, then to the O.T.M. s.r.l., the ordered parcel. It will be taken care of by O.T.M. s.r.l. make a new shipment to try to deliver the product to the customer, only if the order has already been paid by credit card, postal current account or bank transfer. This attempt to return the product will not take place in any way, however, if the customer has chosen to pay by cash on delivery. It will also be faculty of O.T.M. s.r.l. exclude the Customer from the Service for lack of collaboration.

In some cases of multi-product sales, the cash on delivery payment will be recorded on a single shipment even though there may be multiple deliveries.

If the customer chooses payment by cash on delivery and does not expressly communicate in writing (by email or registered letter) his will to cancel the order and subsequently refuse the goods for his own reasons, returning them to the sender, O.T.M. s.r.l. reserves the right to charge the customer the fixed fee of Euro 25.00 (Twenty-five) for shipping, storage and delivery costs as well as any further damages deriving from damage to the goods.

The goods received are considered tacitly accepted (in terms of content, quality and quantity of the same) after 10 working days from receipt of the same without the customer having made any complaints by any means in relation to his order. 5. Prices

All public sale prices of the Products indicated on the Site are expressed in Euros; unless otherwise indicated, the prices of the Products are inclusive of VAT;

The prices of the individual Products, indicated from time to time on the Site, cancel and replace the previous ones;

The prices applied are those indicated on the Site at the time of the purchase order by the Customer, without any consideration of any subsequent price increases or decreases;

In the event of modification of an order, the price of the new products will be the one indicated on the site at the time of the modification if the products are different from those covered by the original order, while the price indicated at the time of the order will remain applicable if the modification only affects the quantity of products already ordered.


6. Responsibility of O.T.M. srl

O.T.M. s.r.l. assumes no responsibility for disservices attributable to force majeure of any nature and kind, in the event that it fails to execute the contract within the time agreed. Causes of force majeure, by way of example but not limited to, are the provisions of the Public Authority, the strike of its own employees or of the carriers of which O.T.M. s.r.l. makes use of, as well as any other circumstance that is beyond the control of the latter.

We also inform our kind customers that the photos published could, in some specific cases, differ from what was actually delivered (for example, O.T.M. s.r.l. does not physically have the possibility of finding different photographs for each color variant). In any case of discrepancy between the description and the published photo, the description of the product on the published photo always takes precedence. The Customer Service is however available for further information regarding any product.


7. Customer obligations

The Customer undertakes to print and keep these General Conditions; the information contained in the General Conditions must be viewed and accepted by the Customer before sending the purchase order, in order to fully satisfy the condition referred to in articles 3 and 4 of Legislative Decree no. 185/1999. Acceptance takes place by marking the appropriate space on the site or by implicit acceptance by telephone order. Failing this, the order cannot be executed.

For all orders made by telephone/mail/fax, the conditions of sale are understood to be implicitly accepted.


8. Right of withdrawal

9. Promotions and Gifts

The Promotions proposed by O.T.M. s.r.l. they are valid until stocks of the Products are exhausted and within the purchase limits indicated on the Site; Promotions are cumulative;

the Promotional Products can be delivered in promotional packages, different from those published on the Site;

the offer of any free Products is valid until stocks last;;


10. Product Warranties

O.T.M. s.r.l. guarantees that products equal to those indicated and described on the Site will be delivered; if the breakage or lack of a product is ascertained or the presence of an item that does not conform to the order or if a replaced product (Art. 6.2) should not be to the customer's liking, the latter has the right to request delivery or the replenishment of the missing or non-conforming product or the crediting on the next order of the amount equal to the value of the disputed product or products;

Communications of the aforementioned anomalies must be made, within 3 days from the delivery date, to the addresses indicated in these General Conditions. The costs for replacing the Product are borne by O.T.M. srl;

O.T.M. s.r.l. guarantees compliance with all the rules regarding the conservation of the products until the time of delivery to the place indicated in the order. Any liability of O.T.M. is excluded. s.r.l. regarding the bad condition of the products due to inadequate storage after delivery.

11. Disputes

Any dispute relating to the application, execution, interpretation and violation of the contract stipulated online by the Customer with O.T.M. s.r.l., is subject to Italian jurisdiction; for any dispute between the parties in this regard, the Court of the place of residence or domicile of the Customer is competent, if located in the Italian territory;

If the domicile of the Customer or his residence are not within the Italian territory, the competent Court is that of execution of the contract.


12. Applicable Law and Referral

The contracts stipulated online by the Customer with O.T.M. s.r.l. are governed by Italian law; for anything not expressly provided here, the provisions of law applicable to the relationships and cases provided for in the contract stipulated online by the Customer with O.T.M. srl; Pursuant to articles 1341 and 1342 of the Civil Code, the Customer declares to have carefully read and to expressly accept and in particular the following clauses of the General Conditions of Sale of O.T.M. s.r.l.: 6.
